Ordinance 34.101.12

AN ORDINANCE AMENDING CHAPTER 231 (HOUSING) OF THE CODE OF THE CITY OF ALBANY IN RELATION TO RESIDENTIAL OCCUPANCY PERMITS AND THE REGISTRATION OF RENTAL DWELLINGS

The City of Albany, in Common Council convened, does hereby ordain and enact:

Section 1. Section 231-130 of Chapter 231 of the Code of the City of Albany is amended with the addition of subsection H:

H. The Administrator has the authority to cancel, rescind or revoke a Residential Occupancy Permit that was issued in error.

Section 2. Section 231-142 of Chapter 231 of the Code of the City of Albany is amended to read as follows:

§ 231-142. Change in registration information.

A. The owner of any rental dwelling already registered with the City shall reregister [within 30 days] immediately after any change occurs in registration information. [A new owner of a registered dwelling shall register the dwelling with 60 days of assuming ownership.]

B. Upon sale or transfer of title to a piece or parcel of land located in the City of Albany on which a rental dwelling unit is located, the purchaser shall provide a new rental dwelling property application to the Department of Buildings and Regulatory Compliance at the time of closing.

C. The new owner of a rental dwelling unit must schedule an inspection of the rental unit or units with the Department of Buildings and Regulatory Compliance.

Section 3. This ordinance shall take effect immediately.

To officially authorize AFD/Buildings and Regulatory Compliance to revoke an ROP if it is found that it was issued in error. Mandating that the City be notified and updated immediately of any change in conditions or sale of a rental unit.
